General Terms and Conditions (GTC)

1. Subject matter of the contract
These General Terms and Conditions (GTC) apply to the processing of all orders from business and private customers placed with Vino Vintana AG.

2. Conclusion of contracts
Placing an order shall be deemed acceptance of the delivery and sales conditions. Buyers may place orders in person, by telephone, by fax, by letter, by e-mail, or via the online shop. By sending or placing an order, the buyer expressly agrees to these GTC. Ordering goods is permitted only to persons who are legally able to enter into binding contracts.

3. Delivery conditions
Delivery of the ordered items is exclusively within Switzerland and the Principality of Liechtenstein. You will conveniently receive the goods via home delivery directly to your home. We deliver to any desired address in Switzerland and the Principality of Liechtenstein. Delivery is generally carried out by our courier or by the postal service VinoLog.

Please note that if delivery is made by VinoLog, the order will be taken back if you are not at home. In this case, you will receive a collection notice and can pick up your order at the nearest post office or arrange a redelivery date. After delivery by the courier, Vino Vintana AG assumes no further liability. In the case of delivery by VinoLog, the goods are normally handed over in person. VinoLog may also deposit the ordered wines in protected places. However, this is normally not done. If you would like to receive the goods only in person in order to avoid theft, you have the option of selecting the Signature shipping method. This way, the parcel will be delivered only against signature.

3.1 Delivery time
You will receive the items within approximately 2 to 5 working days after receipt of your payment. Delays due to other influences (e.g. Christmas season, New Year, Black Friday and Easter) cannot be ruled out with certainty.

3.2 Delivery costs
The shipping cost share per delivery to one address is CHF 18.50. For orders with a value exceeding CHF 99.-, the shipping cost share is waived. In this case, the shopping cart automatically shows shipping costs as 0.

4. Prices and payment terms
Our prices are stated in Swiss francs (CHF) and include statutory value added tax (VAT). The share of shipping costs is not included in these prices and will be charged separately upon delivery.
In principle, the same prices apply in the Vino Vintana Shop as in the sales outlets, excluding promotional prices and special offer prices. Promotional and special offer prices offered in Vino Vintana sales outlets apply to the Vino Vintana Shop only if this is expressly stated.

The following payment options apply:
In the webshop: advance payment, Mastercard, Visa, PayPal, Post Finance Card and Twint. In the sales outlets: cash payment, EC-Maestro, Postcard, Mastercard, Visa.

Wines offered in the online shop are not necessarily available for purchase in the Vino Vintana sales outlets. A few regional wines from Vino Vintana AG sales outlets are not offered in the Vino Vintana online shop.

Sold-out goods are excluded from the ordering process.

The prices published at the time of ordering apply. Changes to the range, vintage, price and conditions, availability, as well as the correction of obvious errors and typographical mistakes remain reserved. Claims for damages resulting from obvious errors and typographical mistakes are excluded.

5. Complaints / returns
Complaints due to incorrect or defective deliveries must be reported within 5 working days of receipt of the goods. After expiry of this period, complaints may be rejected. Incorrect or defective items must always be returned together with a copy of the order confirmation or delivery note using the return label created by us. In the event of a justified complaint, the items will be replaced. A refund of the purchase price and/or acceptance of the return is no longer possible after 5 working days. All further claims are expressly excluded.

6. Corked wines
The occurrence of cork taint (also: corked wine, cork taste) can only be determined when the wine is consumed. For a complaint, the receipt/order confirmation and the cork and lot number of the wine are required so that it can be processed promptly. Promotional wines are excluded from exchange or credit. You have a faulty wine. We are happy to help you. You can report the bad bottles to us within two years from the date of purchase and they will be credited to you. Depending on the wine and quantity, we reserve the right to take the wines back for inspection. The bottles should still be 2/3 full. After inspection by our customer service, you will receive a voucher for the value of the bottle and may use it for your next purchase.

7. Retention of title
All delivered products remain the property of Vino Vintana AG until full payment has been made. Vino Vintana AG is entitled to make a corresponding entry in the retention of title register. If the buyer is in default of payment, Vino Vintana AG is entitled to withdraw from the contract (declaration of withdrawal) and take possession of the goods. By placing the order and simultaneously confirming the GTC, the customer consents to the entry of such a retention of title.

8. Data protection
Vino Vintana AG assures that it will comply with the provisions of the Swiss Data Protection Act and the legal regulations when collecting, processing and using personal data. Data will be passed on to third-party partner companies only insofar as this is absolutely necessary for proper performance (order processing). Upon request, the buyer also has the right at any time to inspect the data stored about them and to prohibit its future use. Vino Vintana AG requires your date of birth because Vino Vintana AG does not deliver any alcoholic beverages to minors.

9. Liability
Claims for damages arising from impossibility of performance, breach of contract, fault at the time of contract conclusion and tort are excluded, insofar as there is no intentional or grossly negligent act. Liability for indirect damages and consequential damages resulting from delayed delivery, from use, from malfunction or failure of performance is excluded.

10. Intellectual property
Vino Vintana AG reserves all rights for all designs, graphics, photos and texts on its websites. Copying or any other reproduction of the websites is permitted only for the purpose of placing an order with Vino Vintana AG. All trademarks, trade names, product names or company names and logos depicted or cited on the websites are the sole property of Vino Vintana AG or the respective authorized market partners and are subject to statutory property and copyright law. Any general use requires the buyer to obtain the express written consent of Vino Vintana AG in advance.

11. Web content
Vino Vintana AG assumes no warranty for the content. For system-related reasons, text content as well as price information may contain errors.

12. Sale to minors
According to legislation, the sale of alcohol to minors is subject to various restrictions. The seller generally does not sell alcohol to minors under 18 years of age. By providing the date of birth, the buyer bindingly states their age so that this regulation and the statutory provisions can be complied with.

The contractual provisions between you and Vino Vintana AG are subject to Swiss law. The place of jurisdiction for all disputes is Lucerne.
